1. OVERVIEW & BINDING AGREEMENT

This website is operated by Gloss Boss Designs. Throughout the site, the terms “we”, “us” and “our” refer to Gloss Boss Designs. By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions. If you do not agree to all terms, you may not access the website or use any services.

2. NO USE BY MINORS & SAFETY WARNING

  • Age Requirement: By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.

  • CHOKING HAZARD WARNING: Gloss Boss Designs products contain small parts. They are NOT toys and are NOT recommended for children. By purchasing, you acknowledge that these items pose a potential choking hazard and agree that Gloss Boss Designs is not liable for any injury, death, or damage resulting from the use of our products by or around minors.

3. ARTISAN VARIANCE & PRODUCT REPRESENTATION

  • Handmade Nature: You acknowledge that our products are handmade. Due to this artisan process, slight variations in color, sparkle placement, and finish are inherent and expected. These are not considered defects.

  • Display Settings: We cannot guarantee that your device's display of any color will be accurate.

4. PURCHASE, CANCELLATION, & REFUND POLICY

  • Final Sale: Due to the nature of custom and handmade work, all sales are final. Once an order is placed and payment is processed, we do not accept cancellations or modifications.

  • Refund Eligibility: Refunds are only issued for items that are proven defective, damaged upon arrival, or lost in transit (subject to carrier investigation).

  • Damage Claims: You must provide high-quality photo evidence of the damage and the original packaging to info@glossbossdesigns.com within 48 hours of delivery to be eligible for a claim.

5. SHIPPING, LOSS, AND INCORRECT ADDRESSES

  • Transfer of Risk: Once a package is transferred to the shipping carrier, the title and risk of loss pass to you (the customer). Gloss Boss Designs is not liable for carrier delays, theft (porch piracy), or weather-related issues.

  • Customer Error: If a package is returned to us due to an incorrect address provided at checkout, the customer is responsible for all additional shipping costs to resend the item.

6. MANDATORY DISPUTE RESOLUTION & CHARGEBACK BAN

  • Good Faith Contact: You agree to contact info@glossbossdesigns.com to resolve any issues before initiating a chargeback or dispute via your bank or payment processor.

  • Chargeback Penalty: Chargebacks cause irreparable financial and administrative harm. If you initiate a chargeback without contacting us first, you will be permanently blacklisted and banned from all future purchases and access to our Service.

7. RELATIONSHIP WITH SHOPIFY

Gloss Boss Designs is powered by Shopify. You acknowledge that Shopify provides the e-commerce platform but is not responsible for the products, fulfillment, or any injury/loss resulting from your purchase. You hereby release Shopify from all claims related to your transactions with us.

8. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

THE SERVICES AND ALL PRODUCTS ARE PROVIDED 'AS IS' WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. IN NO CASE SHALL GLOSS BOSS DESIGNS, OUR OFFICERS, OR AFFILIATES BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE OR ANY PRODUCTS PROCURED THROUGH THE SERVICE.

9. INDEMNIFICATION

You agree to indemnify and hold Gloss Boss Designs harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third-party.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, USA. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Indiana.
